Village Local Tax Receipts


All businesses and licensed professionals in the Village must have a Local Tax Receipt to operate (known as an Occupational License prior to the State of Florida redefinition for 2007-2008).

Receipts are issued on an annual basis from October 1 to September 30. Statements are mailed in August and must be paid by October 1 of each year to avoid a late fee. Should a business open during the year or relocate to a new store, a new Local Business Tax Receipt must be obtained for that year.

APPLYING FOR A NEW LOCAL BUSINESS TAX RECEIPT:

 

  1. Download and fill out a Local Business Tax Receipt application form (PDF).

    NOTE: First-time applicants are requested to come in person to Suite 250, Village Hall, to fill out the forms.

  2. If you are opening a new commercial business, bring the completed application form, plus the following documents, to William Fehr, the Village Zoning Plan Reviewer. He will verify that the type of business being proposed is allowed in the leased or purchased commercial space and all occupancy issues, including parking, are met.

  3. During the processing of your Local Tax Receipt application the form will be perforated and stamped. Bring any additional needed documents as listed below. A Certificate of Use approval stamp will be affixed on the reverse of the Receipt after Step 1 is successfully completed.The form will be given to Zoning personnel to confirm that the type of business being proposed is allowed in the leased or purchased commercial space. The form will be stamped/perforated upon approval.

    • Original and Copy of the By-Laws / Articles of the Company
    • Original and Copy of Fictitious Name - DBA - Certificate   (To apply online, visit the State E-filing website at www.sunbiz.org)
    • Original and Copy of the Federal Identification Number (FEIN)
    • Original and Copy of the Lease Document

  4. Approval by Miami-Dade County Department of Environmental Resource Management (DERM) is required before the Village Receipt Certificate is issued to verify your business will comply with all local, state and environmental laws. You must take the approved, perforated and initialed Village application form to DERM.

    To review: The Village form MUST BE signed by the Zoning official after being checked and authorized for the requested use and perforated before going to DERM.

  5. Once you obtain the Miami-Dade County DERM stamp, bring the form back to the BZPPW Department for payment and issuance of your Village Local Tax Receipt Certificate.

  6. NOTE: If the Business is a Home Office:

    • Signage is prohibited.
    • No customer may be served in the home.
    • Employees in the business are limited to full time residents of the Dwelling Unit.
    • No deliveries/parcel/mail are to be received at the residential address.

  7. NOTE: If you are opening a Restaurant:

    • All five of the documents for opening a business are required
    • You also need the following:
    • Original and Copy of the Alcoholic Beverage License Permit Application form. (This form can be downloaded at www.myflorida.com/dbpr/, and submitted to Division of Alcoholic Beverages and Tobacco; 1940 North Monroe St. Tallahassee, FL 32399. Phone 850-487-1395; Fax 850-922-5175.)
    • Original and Copy of Outdoor Dining Facility application and permit from the Village. (This permit application is available from Jud Kurlancheek, BZP Director; Phone 305-365-8908)
    • Original and Copy of License to Operate from the Division of Hotels and Restaurants. (This form can be obtained from the Division of Alcoholic Beverages and Tobacco; 1940 North Monroe St. Tallahassee, FL 32399-1011. Phone 850-487-1395; Fax 850-488-151; Email: callcenter@dbpr.state.fl.us)

  8. NOTE: If you are opening a Beauty Salon/Spa:

    • All five of the documents for opening a business are required
    • You also need the following:
    • The individual application form for professionals
    • Copy of the license issued by the State of Florida and
    • Payment of $41.35 from any person working at the business with a license issued by the State of Florida

  9. NOTE: Business Signs and Banners:

    • Allowed uses are given in the Village of Key Biscayne Code, Sec. 30, Article VII - Signs, available online under the Document Center Main Menu item in the Building, Zoning and Planning section.
    • General Information:
    • No hand-delivered advertising door-to-door, on cars, in the street.
    • No magnetic signs allowed on cars or trucks.

APPLYING FOR A NEW LOCAL LICENSED PROFESSIONAL TAX RECEIPT:

If you are a Professional with a License issued by the State of Florida:

  1. Download and fill out a Local Licensed Professional Tax Receipt application form (PDF).

  2. Bring the form plus a Copy of the State License and payment to the BZPPW Department.

YOU MAY BE ASKED THESE QUESTIONS DURING THE LOCAL TAX RECEIPT INTERVIEW:

  • Will this business ...

    • Be a professional association?
    • Join an existing office?
    • Have door-to-door service?
    • Operate from a home?
    • Require state licensing?
    • Require a Local Tax Receipt transfer (if an existing business)? If Yes, provide the original Tax Receipt.
    • Serve liquor?
    • Serve food?
    • Sell tobacco products?
    • Have day or adult care services?
    • Require any work or alterations in the new space? If Yes, describe the work to be performed.
    • Be a not-for-profit organization? If Yes, provide a copy of the non-for-profit documentation.

  • What is the ...
    • Number of employees including owners and management?
    • Number of coin-operated machines at the location (i.e., soda, cigarette, washer, dryer, etc.).
